Building Setbacks
The following is an excerpt from Council's Policy Document.
SETBACKS
Floor Level:
The finished floor level of buildings shall be a minimum of 300mm above finshed ground level.
Rural Buildings:
Minimum setbacks for rural dwellings and ancillary buildings are 20 metres from the front boundary and five (5) metres from the side boundaries, unless altered by the standards listed below:
Kilkerrin Lakes Estate -
- In addition to the above requirements, a minimum setback of 20 metres from the Kilkerrin Lake side boundary is required.
Kilkerrin Vines Estate -
- A 10 metre setback from the front property boundary and eight (8) metres from side boundaries are required. In addtion, a minimum 30 metre setback from the existing grape vines has been established. Dwelling and shed building envelopes are to be developed for each new stage and adhered to;
- Corner lots will be assessed on a case-by-case basis having regard to driver's sight lines and the legth and height of fencing that may face a street as a result of the desired setbacks.
River Park Drive -
- A minimum 10 metre setback from the front boundary is required. Side and rear setbacks must comply with the Building Code of Australia 2007;
- Corner lots will have one setback of 10 metres and the adjacent setback may be 7.5 metres;
- Corner lots will be assessed on a case-by-case basis having regard to driver's sight lines and the legth and height of fencing that may face a street as a result of the desired setbacks.
Winbi Estate -
- A minimum 10 metre setback from the front boundary is required. A side setback of five (5) metres has also been established;
- Corner lots will have one setback of 10 metres and the adjacent setback may be 7.5 metres;
- Corner lots will be assessed on a case-by-case basis having regard to driver's sight lines and the legth and height of fencing that may face a street as a result of the desired setbacks.
Layfield Downs -
- A minimum 10 metre setback from the front boundary is required. A side setback of five (5) metres has also been established;
- Corner lots will have one setback of 10 metres and the adjacent setback may be 7.5 metres;
- Corner lots will be assessed on a case-by-case basis having regard to driver's sight lines and the legth and height of fencing that may face a street as a result of the desired setbacks.
Perricoota Run Estate -
- A minimum 10 metre setback from the front boundary is required. A side setback of five (5) metres has also been established;
- Corner lots will have one setback of 10 metres and the adjacent setback may be 7.5 metres;
- Corner lots will be assessed on a case-by-case basis having regard to driver's sight lines and the legth and height of fencing that may face a street as a result of the desired setbacks.
Lakeview Estate -
- A minimum 10 metre setback from the front boundary is required. A side setback of five (5) metres has also been established;
- Corner lots will have one setback of 10 metres and the adjacent setback may be 7.5 metres;
- Corner lots will be assessed on a case-by-case basis having regard to driver's sight lines and the legth and height of fencing that may face a street as a result of the desired setbacks.
In addtion, rural subdivisions adjacent to viticulture or other intensive horticultural land uses, will have a minimum setback of 30 metres from a boundary adjoining these uses.
URBAN BUILDINGS
Residential Buildings:
- A six (6) metre minimum front setback is required. However, encroachments on this minimum will be considered if consistent with existing dwellings.
- Corner lots will have one setback of six (6) metres and the adjacent setback may be 4.5 metres.
- Corner lots will be assessed on a case-by-case basis having regard to driver's sigh lines and the legth and height of fencing that may face a street as a result of the desired setbacks.
- Encroachments on these minimums will be considered if consistent with existing building setbacks and street character.
- Side and rear setbacks must comply with the requirements of the Building Code of Australia 1996.
Commercial Buildings:
Setbacks are as per residental buildings, however to maintain commercial precinct higher density character, Council will accept building to the front and side boundary lines.
Industrial Buildings:
Industrial buildings must be set back a minimum of 10 metres from the front boundary and three (3) metres from each side and rear boundary. This three (3) metre setback for side and rear boundaries includes materials stored outdoors, to reduce the spread of fire. In addition to the above, in Moama Business Park, a setback of five (5) metres from a side street is required on a corner lot.
STUMPS
Red gum or timber stumps or sole plates are not permitted to be used in Murray Shire.
